Terms of Service for Application and Store

§ 1. General Provisions

These Terms of Service define the rules for using the Irrify mobile/web application (hereinafter: "Application"), the rules for making purchases in the store available in the Application, and the rules for providing services electronically.

The owner and administrator of the Application is: Business & Finance Solutions Paweł Nowecki with its registered office at: Aleksandria 33, 96-330 NIP: 8381820281, REGON: 364419062, registered in CEIDG. Contact details: kontakt@irrify.ai, +48 791 893 867.

These Terms are directed to both consumers and entrepreneurs using the Application.

§ 2. Technical Requirements

To use the Application, the following are required: a) End device with internet access (smartphone, tablet, computer). b) Operating system: [e.g. Android min. version 8.0 / iOS min. version 13]. c) Active email address.

The Administrator makes every effort to ensure the Application operates continuously, however, reserves the right to technical breaks for system updates.

§ 3. User Account

  • Browsing the store's assortment does not require creating an account.
  • Placing an order and using some Application features requires account registration.
  • Registration is free and voluntary.
  • The User is obliged to provide true data.
  • The User may delete their Account at any time using the "Delete account" option available in the Application settings or by sending an appropriate request to the Administrator's email address.
  • The Administrator reserves the right to block or delete the User's Account who grossly violates these Terms (e.g. attempts to defraud the payment system).

§ 4. Order Placement Rules (Store)

  • Product prices in the Application are gross prices (including VAT) and are expressed in the currency corresponding to the selected country.
  • Prices do not include delivery costs, which are indicated during order placement.
  • To place an order, the User: a) Adds a product to the virtual cart. b) Fills out the delivery form. c) Selects payment and delivery method. d) Confirms the order with the "Order and Pay" button (or equivalent).
  • The sales contract is concluded upon the User receiving an email confirmation of order acceptance for fulfillment.

§ 5. Payments and Delivery

  • Available payment methods: a) Electronic payments (e.g. BLIK, instant transfer) processed by operator [e.g. PayU/Przelewy24]. b) Payment card. c) [Other methods, e.g. cash on delivery].
  • Orders are fulfilled within the European Union.
  • Order fulfillment time is from 1 to 30 business days.
  • Available delivery methods: Courier, InPost Parcel Lockers.

§ 6. Irrigation Planner Subscriptions

  • The Application offers subscription plans providing access to advanced irrigation planner features (e.g. Basic, Standard, Premium).
  • Subscription payments are processed by Stripe and occur automatically on a monthly cycle.
  • Users may cancel their subscription at any time through account settings. Canceling a subscription means that after the current billing period ends, access to premium features will be limited to the Basic plan.
  • Subscription invoices are automatically generated by Stripe and are available in the user profile and sent to the email address associated with the account.

§ 7. Right to Withdraw from Contract (Returns)

  • A User who is a Consumer (or Entrepreneur on consumer terms) has the right to withdraw from the sales contract within 14 days from the date of receiving the goods, without giving a reason.
  • To exercise the right to withdraw, a clear statement must be made (e.g. by email) and the goods returned to the Administrator's address.
  • The cost of returning the goods (direct return cost) is borne by the Consumer.
  • The Seller refunds the Consumer all payments made (including the cost of the cheapest delivery offered in the store) within 14 days of receiving the statement or return of goods.
  • The right to return does not apply in cases specified by law (e.g. perishable products, opened hygiene products after delivery, personalized products).

§ 8. Complaints

  • The Seller is obliged to deliver goods free from defects.
  • In case of physical or legal defects, the User has the right to file a complaint based on warranty/non-conformity of goods with contract regulations.
  • A complaint can be filed electronically at kontakt@irrify.ai or in writing at Aleksandria 33, 96-330.
  • The Seller will process the complaint within 14 days of receipt.

§ 9. Terms Changes

  • The Administrator reserves the right to change the Terms for important reasons (e.g. change in law, introduction of new payment features).
  • Users with Accounts will be notified of Terms changes by email with at least 7 days' notice.
  • In case of non-acceptance of the new Terms, the User has the right to terminate the contract (delete account).
  • Orders placed before Terms change are subject to the version in force at the time of order placement.

§ 10. Liability and Prohibited Content

  • It is prohibited for Users to provide unlawful content (e.g. in comments, reviews or during registration), in particular offensive content, inciting hatred or violating copyrights.
  • The Administrator is not responsible for interruptions in Application operation caused by force majeure or failures independent of the Administrator (e.g. cloud provider server failure), unless the law provides otherwise.

§ 11. Final Provisions

  • Matters not regulated by these Terms are governed by the Civil Code, Consumer Rights Act and other applicable provisions of Polish law.
  • All disputes will be resolved by competent common courts.
